1. INTRODUCTION
Data governance plays a pivotal role in shaping the socio-economic landscape of nations. In
line with the continent’s leadership efforts to prioritise and accelerate digitalisation, the Africa
Union Commission (AUC) engaged in the development of a comprehensive Digital
Transformation Strategy (DTS). To implement some of the DTS recommendations, the AUC
developed the AU Data Policy Framework (DPF) which was endorsed in February 2022. This
strategy among others, seeks to harness digital technologies and innovation to transform African
societies and economies while promoting Africa’s integration, generate inclusive economic
growth, stimulate job creation, bridge digital divides, and eradicate poverty. It also provides a
common, coordinated digitalization agenda to enhance synergies and avoid duplication of
efforts. This strategic framework aligns with Africa’s goal for inclusive and sustainable
development, emphasizing unity, self-determination, freedom, progress, and collective
prosperity.
AUDA-NEPAD organized a virtual inception meeting on 16 January 2025, with the Minister of
Posts, Telecommunications, and Digital Development of Madagascar in attendance, to have a
better understanding of the Malagasy digital ecosystem and their priorities to design an informed
Technical Assistance solution for Madagascar for the AU DPF domestication. This followed the
successful launch of the implementation of the Data Governance project in February 2024 and
a series of virtual inception meetings with AU member states and Regional Economic
Communities (RECs).
2. SCOPE/MAIN RESPONSIBILITIES OF THE ASSIGNMENT
The Consultant shall work with the AUDA-NEPAD and Madagascar’s relevant authorities to
conduct all relevant activities necessary to develop a national Data Policy including:
a. Initiation with information gathering (Self, Capacity Assessment Tool, stakeholders'
engagement meeting, etc.;
b. Initial policy development road map proposal;
c. Research & Analysis, including literature review, benchmark, comparative analysis,
assessment, interviews of the key informants for the policy development;
d. Facilitation a multi-stakeholders' national consultation, followed with a clear
roadmap for the policy development;
e. Draft Development of a national data policy for Madagascar, ensuring that it aligns
with AU DPF and national, regional and continental data governance frameworks;
and
f. Facilitation of the Draft reviews and validation.
3. DELIVERABLES
The consultant will be required to deliver on the following:
a. Inception Report including road map and timelines and initial country landscape
information, with Country Data Governance landscape analysis;
b. Madagascar Data Governance needs assessment report;
c. Iteration of draft National Data Policy for Madagascar; and
d. Final draft Madagascar national data policy.
4. AUDA-NEPAD now invites eligible individual consultants (“Consultants”) to indicate their
interest in providing the Services. Interested Consultants should provide information
demonstrating that they have the required qualifications and relevant experience to perform
the Services.
5. QUALIFICATIONS, EXPERIENCE AND COMPETENCIES
Qualifications and Skills
o Master’s degree in Law (with a focus on Technology law), Information Security,
Data Governance, Public Policy, or other related field. A PhD is an added
advantage.
Experience
o At least 7 years’ experience working in matters relating to data governance;
o Demonstrable expertise and experience in the development of policies;
procedures and tools for institutional development;
o Proven record of having similar development of national policies across AU
member states;
o Good knowledge of working with development agencies;
o Deep understanding of data governance instruments, globally and locally;
o Proficiency in English and French
6. SHORTLISTING CRITERIA
For evaluation of the expressions of interest, the following criteria will be applied with a pass mark
of 70 points:
i. Qualifications - Education and Relevant Training (30 points);
ii. Experience related to the assignment (20 points);
iii. Similar experience to the assignment (40 points);and
iv. Knowledge and experience of the region & local conditions (10 points).
A Consultant will be selected in accordance with Individual Consultant Selection (ICS) method
set out in the AU Procurement Manual.
7. SUBMISSION REQUIREMENTS
Interested candidates are requested to submit the following documents for AUDA-NEPAD
consideration:
i. Cover letter;
ii. Signed declaration of undertaking (downloadable from AUDA-NEPAD website and attached
as Annex 1 below);
iii. Curriculum Vitae (CV); and
iv. Proof of stated qualifications in the form of copies of the degrees obtained.
Failure to submit to any of the above documents will lead to exclusion from being evaluated further
8. REPORTING AND TIME SCHEDULES:
In undertaking this exercise, the Consultant will be expected to frequently exchange and interact
with senior Data Policy Analyst or her designated.
9. Only Individual Consultants are eligible for this assignment if they fulfil the following
eligibility criteria:
a) Have no conflict of interest in relationship to performance of this assignment;
b) Are not subject to, and not controlled by any entity or individual that is subject to, a
temporary suspension or a debarment imposed by the African Union Commission, World
Bank or any other multilateral development bank and being listed on the website
http://www.worldbank.org/debarr or respectively on the relevant list of any other
multilateral development bank. Further, are not ineligible pursuant to a decision of the
United Nations Security Council;
c) Have not been convicted by a final judgement or a final administrative decision or subject
to financial sanctions by the United Nations or Country for involvement in a criminal
organisation, money laundering, terrorist-related offences, child labour or trafficking in
human beings; this criterion of exclusion is also applicable to legal Persons, whose
majority of shares are held or factually controlled by natural or legal Persons which
themselves are subject to such convictions or sanctions;
d) Are not being bankrupt, wound up or ceasing our activities, having our activities
administered by courts, having entered receivership, reorganisation or being in any
analogous situation;
e) Are not involved in corruption: offering, giving, receiving or soliciting, directly or indirectly,
anything of value to influence improperly the actions of another party;
f) They have not been the subject of a judgment which has the force of res judicata for
fraud, corruption, involvement in a criminal organization or any other illegal activity
detrimental to the AUDA-NEPAD financial interests;
g) they have not been declared guilty of gross professional misconduct proven by any
means which AUDA-NEPAD can justify;
h) Comply with their national tax and social security laws
